1000675863 ONTARIO INC. (“Pollin Clinic”) has created this privacy policy (“Privacy Policy”) in order to demonstrate our commitment to your privacy. The following describes our practices for collecting, using, and disclosing Personal Information for the purpose of providing or offering our services to you. Our services are provided through a mobile Platform developed and operated by our service provider Pollin Inc. (“Pollin”). For clarity, this Privacy Policy applies to the Pollin Platform which includes a mobile application and Pollin’s booking websites located at and under the domain https://www.pollinfertility.com/ ("Website”). It also applies to your communications or interactions with the Pollin Clinic, and as described in this Privacy Policy. This Privacy Policy operates in tandem with the enclosed Terms of Service.
By interacting with us, or by choosing to submit Personal Information through the Pollin Platform, you consent to all of the terms of this Privacy Policy. If you do not agree with any terms of this Privacy Policy, please do not interact with us or submit any Personal Information through the Pollin Platform.
Please note that when you access any external links from the Website (including any Pollin subsidiary Websites) or via the App, they may have different privacy policies specific to those third-party websites. We are not responsible for such third-party websites, and we encourage you to read all privacy policies posted on the third-party websites that you visit.
This Privacy Policy applies to any Personal Information or Personal Health Information that we collect or receive about you, from you or any other source.
“Personal Information” as used in this Privacy Policy refers to any information that identifies, relates to, describes, or is reasonably capable of being associated with a particular individual and that is recorded in any form (such as your name, your phone number, your postal and email address and your payment information), as further defined in the Personal Information Protection and Electronic Documents Act (“PIPEDA”) and applicable provincial legislation. It may also include technical information such as your IP address, browser settings and device ID, but only when this information can identify you as an individual.
“Personal Health Information” as used in this Privacy Policy refers to any information that is regulated under provincial health privacy legislation such as the Personal Health Information Protection Act, 2004. Personal Health Information generally includes identifying information about an individual in oral or recorded form, if the information,
relates to the physical or mental health of the individual, including information that consists of the health history of the individual’s family; or
relates to the providing of health care to the individual, including the identification of a person as a provider of health care to the individual.
Please note that Personal Information and Personal Health Information excludes information that is anonymized and cannot be associated with an identifiable individual and aggregate information which represents compiled data from a group of individuals who can no longer be individually identified.
We have partnered with Pollin Platform to provide state-of-the art connected fertility services. Pollin Platform acts as our service provider partner to collect, use, disclose, and retain personal information and personal health information about you. Your personal information and personal health information will only be processed by Pollin Platform for the purposes of providing you with services through Pollin Clinic.
We ask for consent to collect, use or disclose your personal information, except in specific circumstances where collection, use or disclosure without consent is authorized or required by law.
We generally rely on your implied consent for the collection, use, and disclosure of Personal Information or Personal Health Information is required for the purposes, including providing health care.
In order to use the Platform, which includes the Pollin Website and the Pollin App, you agree you are bound by Pollin Platform’s Term and Conditions.
Pollin Clinic collects Personal Information when you use the Pollin Website, register for an account, use the Pollin App, receive services or interact with us directly. The Personal Information we and Pollin Platform collect directly from you includes:
Personal identifiers. We may collect Personal Information like name, telephone number, e-mail address, date of birth, home or business and mailing address when you access certain areas of the Pollin Websites that require registration for certain services, or if you require more information about those services or send us questions, comments, suggestions or complaints.
Health information. Patients and Patient Partners provide Pollin Clinic and its clinicians with personal health information related to their fertility journey through the Pollin Platform. Your clinicians and health care providers may also provide Pollin Clinic with health information with your consent. This includes providing a medical history, referrals, prior medical records, participating in diagnostic tests, and other health-related information that may assist with the provision of fertility services or which will further a clinicians understanding of the Patient or Patient Partner’s health.
Payment information. If you decide to purchase Pollin Clinic’s products or services, our third-party service provider, Stripe (https://stripe.com/en-ca/privacy), may need to collect certain additional information, like your credit or debit card number and expiration date, bank routing information and account number. Your payment information will also be collected through Shopify (https://www.shopify.com/legal/privacy) if you decide to purchase from Pollin Platform online store or at the clinic.
Device Information. When you connect to our services using Pollin’s Platform or the Pollin Website , Pollin Platform may collect device-specific information such as your device model, operating system, unique device identifiers, and mobile network information. We and Pollin Platform may associate your unique device identifier or phone number with information that you may have used to register for certain services or purchase products. Server logs that are maintained by Pollin Platform or by Pollin Platform’s third-party service providers may contain information about the services that you have used, and your device-specific information. We and Pollin Platform may also maintain digital communication logs that track information like your phone number, calling-party number, forwarding numbers, time and date of calls, duration of calls, and SMS routing information. Pollin Clinic and Pollin Platform may use your device’s IP address or MAC address to track device-event information such as crashes, system activity, hardware settings, browser type, browser language, the date and time of your request and referral URL.
Authentication. When you connect using the Pollin Platform you are required to authenticate your access. Depending on your mobile device and your choices this may include using features such as FaceId, SMS messaging, or biometrics.
Specialized Information. Pollin Clinic and Pollin Platform may collect and store information (including Personal Information) locally on your device through our website or other technologies such as browser web storage (including HTML 5), application data caches, cookies or other similar technologies. Certain services may include a unique application number in connection with the installation of apps. This number and information, including, without limitation, operating system type and app version number may be sent to Our service providers when you install, update or uninstall apps. Pollin Clinic and Pollin Platform may also collect and process information about your general geographic location, such as your postal code, IP address, domain name, your browser type, pages you view, links you click, the length of time you visit or use the service, and how you use the service.
We also collect Personal Information and Personal Health Information as permitted by applicable privacy law from our partner clinics, affiliates and third parties who share information with us so that we can provide or offer our services to you.
Pollin Platform owns and manages Pollin Clinic’s website and applications. Pollin Platform uses third-party web analytics services in connection with the Website and Mobile Application, including Google Analytics, Amplitude Analytics, which use cookies and similar technologies to collect data (such as IP addresses) to evaluate use of and interaction with the Website.
(Pollin Platform uses targeting cookies to record your use of the Pollin Website (including the pages you view and the links you click) and Pollin App to deliver targeted informational content to you. We do not use your personal health information for these purposes. You may learn about Google’s advertising features, including Google Analytics’ currently available opt-out mechanisms here.)
Uses of Personal Information. Pollin Clinic may use Personal Information to operate our business and provide our services. In particular, we may use Personal Information or Personal Health Information to:
provide and offer our services including with contracted service providers who assist us in providing or offering our services including Pollin Platform and medical service providers (laboratory services, and diagnostic imaging services) for the purposes set out in this Privacy Policy;
keep you informed about the status of your fertility journey and particular steps along the way;
communicate with you about our programs, products, and services that may be of interest to you;
to provide customer service and respond to any complaints or inquiries you may have;
to tailor our services and offerings to you;
to evaluate and improve our services, App and Website;
for quality improvement including improving and optimizing our fertility services;
for legal, safety, and security purposes, including to protect our rights, property and safety and those of our employees, customers and the public and to detect and prevent fraud; and,
for any other purpose communicated to you at or prior to the collection of Personal Information.
We may combine Personal Information we obtain directly with information we obtain through third parties for the purposes described above.
We may de-identify or aggregate identifiable information and use it for the purposes described above and for other purposes to the extent permitted by applicable law. We will do so in accordance with applicable law and such that the identity of the individual cannot be determined by a reasonably foreseeable method. The de-identified data will be used by us and Pollin Platform for quality improvement initiatives including, but not limited to, analytics to improve fertility care, the application, and services, training artificial intelligence models, and for Pollin Platform’s own purposes as permitted by applicable law.
We also may use Personal Information for additional purposes that we identify at the time of collection. We will obtain your consent for these additional uses to the extent required by applicable law.
Pollin Platform uses cookies and related tools for capturing Usage Information (collectively “Tracking Technologies”) for the following purposes:
Strictly Necessary. We may use cookies or other Tracking Technologies that We consider are strictly necessary to allow you to use and access Our Website, including cookies required to prevent fraudulent activity and improve security.
Performance Related. We may use cookies or other Tracking Technologies that are useful in order to assess the performance of Our web services, including as part of Our analytic practices or otherwise to improve the content, products or services offered through Our web services.
Functionality Related. We may use cookies or other Tracking Technologies that are required to offer you enhanced functionality when accessing Our web services, including identifying you when you sign in to Our Website or keeping track of Our specified preferences, including in terms of the presentation of content on Our Website.
Targeting Related. We may use Tracking Technologies to deliver content relevant to your interests on Our Website and third-party Websites based on how you interact with Our content. To provide you with connected fertility services and other related services including diagnostic imaging, laboratory analysis.
with payment processors to facilitate payments and billings including to OHIP, insurers, or other government bodies;
with law enforcement or other government agencies;
where needed to protect the property or safety of Our company and employees, contractors, vendors, suppliers, the public and customers;
as required to assert or defend against legal claims;
with government entities or regulators for the purpose of complying with applicable law;
in connection with the sale or merger or any transaction that involves the sale or assignment of some or all of our assets;
with other third parties to the extent required or permitted under applicable law; and,
for any other purpose communicated to you at or prior to the collection of Personal Information.
We and Pollin Platform have implemented physical, electronic, and procedural security measures to assist with safeguarding your Personal Information in our possession, and to help protect against unauthorized access and disclosure. Only our authorized personnel and those of our service providers who perform legitimate business functions are authorized to access your Personal Information to the extent needed to provide those services.
We maintain policies and practices which ensure the protection of your Personal Information. Depending on the volume and sensitivity of the information, the purposes for which it is used and the format in which it is stored, We implement a combination of measures to protect your Personal Information, including:
Internal policies and procedures;
If information is collected or stored in electronic format, technical safeguards such as encryption, firewalls, antivirus software and similar measures;

Pollin Clinic and Pollin Platform will primarily store your personal information and personal health information in Canada. We note that certain services providers and laboratory testing providers may be located in the United States.
Pollin Clinic and its service provider, including Pollin Platform, may process Personal Information and store such data in other countries, including the U.S., which may have different data protection laws than Canada. If we do so, we will process the Personal Information for the purposes described in this Privacy Policy. When we process your Personal Information to recipients in other countries, we will take measures to protect that information in accordance with applicable law.. As a result, this information may be subject to access requests from governments, courts, or law enforcement in those jurisdictions according to laws in those jurisdictions.
By providing us with Personal Information, you understand and expressly agree that we may transfer it outside of Canada or your jurisdiction of residence. If you do not agree to the transfer of your Personal Information outside of Canada, do not provide us with Personal Information.
You may request access to your Personal Information and to request a correction to it if you believe it is inaccurate, incomplete or no longer up to date, subject to limited exceptions set out in applicable laws.

Changing your communication preferences. You may be offered the opportunity to subscribe to and receive additional information about our services and offerings or our partners’ offerings including Pollin Platform. Each commercial e-mail that we send to you will offer you the opportunity to opt-out of continuing to receive such messages. It may take some time to process your opt-out requests. In some instances, we may have already shared your information with one of our authorized service providers before you changed your information preferences. Please note that even if you have indicated your choice not to receive commercial messages from us, we may still communicate with you in connection with a service, in accordance with applicable law (for example, to send you important service information or certain transactional messages).
Changing your browser settings on your device. Pollin Clinic and Pollin Platform use technology to enhance your experience and present you with offers, including personalized advertising. Through technologies such as cookies, the Websites and Platform recognize you when you use or return to them and can provide you with a seamless experience. You may be able to set your browser settings to use the Website without cookies functionality. Please note that if you block cookies, some services, functions and Websites may be unavailable and We will not be able to present personally-tailored content and advertisements to you. Your browser may provide you with some options regarding cookies. For more detailed information about how to disable or administer your cookie settings in your web browser, please refer to the applicable page for the browser you are using.
You can withdraw your consent to allow cookies, change your browser settings, and delete the cookies already stored on your computer at any time. If the changes we make are significant, we will provide a more prominent notice and obtain consent when required by applicable laws. These terms and conditions of use (these “Terms and Conditions”) constitute a legal agreement and are entered into by and between you and Pollin Clinic (“Company,” “we,” “us,” “our”). The following terms and conditions, together with our Privacy Policy, and Pollin Platform’s Terms and Conditions govern your access to and use of the Pollin Platform
The use of the Pollin Mobile App and/or the Website enables users to register for fertility testing and care services (“Testing & Care Services”) delivered through the Pollin Clinic, the collection, use, and disclosure of personal health information by the Pollin Clinic and the communication of test results through the Pollin Mobile App and/or the Website.
At the direction of your connected organization, and with your consent, the Pollin Clinic may order fertility testing or care services and communicate testing results through the Pollin Mobile App and/or the Website.
Electronic communications should not be used to communicate emergency or urgent health matters since messages are not reviewed after hours and can be delayed for reasons beyond the control of my care provider.
The care team will only respond to digital communications during regular weekday clinic hours. My care team will not respond to digital communications after clinic hours or on weekends.
Cancellations made with less than 24 hours’ notice will be subject to the full fee amount of the respective session (e.g., initial consultation, planning session). Exceptions to this fee will be considered for extenuating circumstances.
You must inform Pollin Clinic if you wish to reschedule your original appointment. Appointments must be rescheduled more than 24 hours before the original start time.

By using the Pollin App and/or the Website, you represent and warrant that you are 18 years of age or older. If you are between the ages of 13 and 18 you must fully review these Terms and Conditions with your parent or legal guardian prior to using the Pollin Mobile App and/or the Website. Children under the age of 13 may not use the Pollin Mobile App or the Website.
We reserve the right in our sole and absolute discretion to revise and update these terms and conditions from time to time. Any and all such modifications are effective immediately upon posting and apply to all access to and continued use of the Pollin Mobile App and/or the Website.
To improve the Pollin Mobile App, we may add or remove features, functionalities, and the support of certain devices and platforms. Our services may be interrupted, including for maintenance, repairs, upgrades, or network or equipment failures. We may discontinue some or all of our services, including certain features and the support for certain devices and platforms. Where feasible, we will endeavour to provide you with prior notice of any such discontinuation. Events beyond our control (such as acts of God, flood, fire, earthquake, explosion, war, terrorism, civil unrest, labour actions, national or regional emergencies, or any similar event) may temporarily or permanently impact our ability to provide you with access to the Pollin Mobile App.
The security of your personal information is very important to us. We use physical, electronic, and administrative measures designed to secure your personal information from accidental loss and from unauthorized collection, use, and disclosure. The safety and security of your information also depends on you. Users are responsible for maintaining strong mobile device security protection and for taking other reasonable precautions necessary to prevent others from gaining access to your Pollin Mobile App and/or Website accounts.
Any username, password, authentication link or any other piece of information chosen by you, or provided to you as part of our security procedures, should be unique, must be treated as confidential, and you must not disclose it to any other person or entity.
You are prohibited from attempting to circumvent, and from violating, the security of the Pollin Mobile App and/or the Website, including, without limitation by: (a) accessing content and data that is not intended for you; (b) attempting to breach or breaching the security and/or authentication measures which are not authorized, including by attempting to reverse engineer code or reviewing or modifying application binaries; (c) restricting, disrupting or disabling service to users, hosts, servers, or networks; (d) illicitly reproducing TCP/IP packet headers; (e) disrupting network services and otherwise disrupting our ability to monitor the Pollin Mobile App and/or the Website; (f) using any robot, spider, or other automatic device, process, or means to access the Pollin Mobile App and/or Website for any purpose, including monitoring or copying any of the material on the Pollin Mobile App and/or the Website; (g) introducing any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful; (h) attacking the Pollin Mobile App and/or the Website or any related site or service via a denial-of-service attack, distributed denial-of-service attack, flooding, mailbombing, or crashing; and (i) otherwise attempting to interfere with the proper working of the Pollin Mobile App and/or the Website.
You are prohibited from using the Pollin Mobile App and/or the Website for any illegal or unauthorized purpose, and you must not use the Pollin Mobile App and/or Website to abuse, harass, threaten, impersonate, or intimidate any other Pollin Mobile App and/or Website user.
You understand and agree that the Pollin Mobile App and/or the Website and their entire contents, features, and functionality, including, but not limited to, all information, software, code, text, and displays, are owned by the Company, its licensors, or other providers of such material and are protected in all forms by intellectual property laws and rights including without limitation, copyright, trademark, patent, trade secret, and other proprietary rights.
The Company name, logos, product and service names, designs, images, and slogans are trademarks of the Company or its affiliates or licensors. You must not use such marks without the prior written permission of the Company. Other names, logos, product and service names, designs, images, and slogans mentioned, or which appear on the Pollin Mobile App and/or the Website are the trademarks of their respective owners. Use of any such property, except as expressly authorized, shall constitute an infringement or violation of the rights of the property owner and may be a violation of federal or other laws and could subject the infringer to legal action.
You may only use the Pollin Mobile App and/or the Website for your personal and non-commercial use. You shall not directly or indirectly reproduce, compile for an internal database, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Pollin Mobile App and/or the Website, in any form or medium whatsoever.
Any use of the Pollin Mobile App and/or the Website not expressly permitted by these Terms and Conditions is a breach of these Terms and Conditions and may infringe or violate copyright, trademark, and other intellectual property laws.
The owner of the Pollin Mobile App and/or the Website is based in Ontario, Canada. We provide this Pollin Mobile App for use only by persons located in Canada and the United States and the Website for use only by persons located in Canada. The Pollin Mobile App and Website are not intended for use in any jurisdiction where its use is not permitted. If you access the Pollin Mobile App from outside Canada or the United States and/or the Website from outside Canada, you do so at your own risk and you are responsible for compliance with local laws of your jurisdiction.
YOU UNDERSTAND AND AGREE THAT YOUR USE OF THE POLLIN MOBILE APP AND/OR WEBSITE IS AT YOUR OWN RISK. THE POLLIN MOBILE APP AND THE WEBSITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
THE COMPANY MAKES NO WARRANTY, REPRESENTATION, OR ENDORSEMENT WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, SUITABILITY, ACCURACY, CURRENCY, OR AVAILABILITY OF THE POLLIN MOBILE APP AND/OR THE WEBSITE OR THEIR CONTENTS. YOU ARE SOLELY AND ENTIRELY RESPONSIBLE FOR YOUR USE OF THE POLLIN MOBILE APP AND/OR THE WEBSITE.
The above disclaimer applies to any damages, liability or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction of or unauthorized access to, alteration of, or use, whether for breach of contract, tort, negligence or any other cause of action.
Pollin Platform reserves the right to do any of the following, at any time, without notice: (1) to modify, suspend or terminate operation of or access to the Website, or any portion of the Website, for any reason; (2) to modify or change the Website, or any portion of the Website, and any applicable policies or terms; and (3) to interrupt the operation of the Website, or any portion of the Website, as necessary to perform routine or non-routine maintenance, error correction, or other changes.

YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE POLLIN MOBILE APP AND/OR THE WEBSITE IS TO STOP USING THE POLLIN MOBILE APP AND/OR THE WEBSITE AND ANY RELATED SERVICE.
To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless the Company, its parent, subsidiaries, affiliates, and their respective directors, officers, employees, agents, service providers, contractors, licensors, suppliers, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable legal fees) arising out of or relating to your breach of these Terms and Conditions; your use of the Pollin Mobile App and/or the Website other than as expressly authorized in these Terms and Conditions or breach of privacy or security involving your personal information.
The Pollin Mobile App and/or the Website and these Terms and Conditions will be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice or conflict of law provision.
All disputes and questions whatsoever arising from or in connection with your use of the Pollin Mobile App, the Website and/or these Terms and Conditions or the Privacy Policy shall be resolved by arbitration. Such arbitration shall be conducted by a single arbitrator. The arbitrator shall be appointed by agreement between the parties or, in default of such agreement, such arbitrator shall be appointed by a Judge of the Superior Court of Justice sitting in Toronto, Ontario, upon the application of any of the parties and such judge shall be entitled to act as such arbitrator, if he or she so desires. The arbitration shall be held in the City of Toronto, Ontario. The procedure to be followed shall be agreed to by the parties or, in default of such agreement, determined by the arbitrator. The arbitration shall proceed in accordance with the provisions of the Arbitration Act, 1991 (Ontario). The arbitrator shall have the power to proceed with the arbitration and to deliver his or her award notwithstanding the default by any party in respect of any procedural order made by the arbitrator. The decision arrived at by the arbitrator shall be final and binding subject to a right of appeal to a court of competent jurisdiction on matters of law only. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction.
No failure to exercise, or delay in exercising, any right, remedy, power, or privilege arising from these Terms and Conditions operates, or may be construed, as a waiver thereof. No single or partial exercise of any right, remedy, power, or privilege hereunder precludes any other or further exercise thereof or the exercise of any other right, remedy, power, or privilege.
If any term or provision of these Terms and Conditions is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of these Terms and Conditions or invalidate or render unenforceable such term or provision in any other jurisdiction.
These Terms and Conditions and our Privacy Policy constitute the sole and entire agreement between you and Pollin Platform regarding the Pollin Mobile App and/or the Website and any related service and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding such subject matter.
